Β§ 3 Collection of personal data when visiting our website(1) When using the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

  • Time zone difference to Greenwich Mean Time (GMT)

a) This website uses the following types of cookies, the scope and function of which are explained below:

b) Transient cookies are automatically deleted when you close the browser. These include session cookies in particular. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time in the security settings of your browser.

Β§ 5 Collection of access data and log files

We, or our hosting provider, collect on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR. GDPR, we collect data about every access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.

This data cannot be assigned to specific persons. This data is not merged with other data sources.

Log file information is stored for a maximum of 7 days for security reasons (e.g. to investigate misuse or fraud) and then deleted. Data whose further storage is required for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.

Β§ 6 Contact

(1) When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, your name and telephone number if applicable) will be stored by us in order to answer your questions. We delete the data arising in this context after storage is no longer required, or restrict processing if there are statutory retention obligations.

(2) If we use contracted service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes. We will also state the specified criteria for the storage period.

Β§ 7 Further functions and offers on our website

(1) In addition to the purely informational use of our website, we offer various services that you can use if you are interested. To do so, you must generally provide additional personal data that we use to provide the respective service and to which the aforementioned data processing principles apply.

(2) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly monitored

(3) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.
 

Β§ 8 Event store - webinar and seminar registration

There is a contact form on our website that can be used to register for our free webinars and training events. If a user makes use of this option, the data entered in the input mask will be transmitted to us and stored:

  • Company data: Company
  • Data of the booking contact person (first name, surname, e-mail address, telephone number)
  • IP address of the user
  • Date and time of registration.

The legal basis for the processing of the data is Art. 6 para. 1 lit. b GDPR. The data will only be used to carry out the training event. The data will be deleted after the end of the training event, unless we are obliged to store it for a longer period of time for contractual and/or legal reasons.

Β§ 9 Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers such as webinars, events and news about ERP and CRM (e.g. topics in the Inway blog). The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double opt-in procedure to subscribe to our newsletter. This means that after you have registered, we will send you an e-mail to the specified e-mail address in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store the IP addresses you use and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. After your confirmation, we will save your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare your revocation by clicking on the link provided in every newsletter e-mail, by e-mail to newsletter@inway.de or by sending a message to the contact details given in the imprint.

(5) We would like to point out that we evaluate your user behavior when sending the newsletter. For this analysis, the emails sent contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the evaluations, we link the data mentioned in Β§ 3 and the web beacons with your e-mail address and an individual ID. Links received in the newsletter also contain this ID. We use the data obtained in this way to create a user profile in order to tailor the newsletter to your individual interests. We record when you read our newsletters, which links you click on in them and deduce your personal interests from this. We link this data to the actions you take on our website.

You can object to this tracking at any time by clicking on the separate link provided in each email or by informing us via another contact channel. The information will be stored for as long as you are subscribed to the newsletter. After you unsubscribe, we store the data purely statistically and anonymously. Such tracking is also not possible if you have deactivated the display of images in your e-mail program by default. In this case, the newsletter will not be displayed in full and you may not be able to use all the functions. If you display the images manually, the above-mentioned tracking will take place.

Β§ 11 Dealing with application

(1) Storage period
We process the personal data provided by you as part of your application exclusively for the purpose of carrying out the application process Your applicant data will not be stored for longer than 12 months after receipt of your application, unless you have given an extended declaration of consent, which refers to a maximum storage period of 36 months.

(2) Data categories, purpose of processing and legal basis:
The personal data from your application that you provide on our applicant page will be processed by us for the purpose of applicant selection. If suitable, your data will be transferred within the Inway Group for further processing as part of the selection process. The responsible managers of the respective companies have access to this data.
 

For example, we process the following personal data from your application and during the selection process:

  • First name, last name
  • Application photo
  • Nationality
  • Communication data (such as private address, telephone number)
  • Indication of age of majority/minor
  • Application data (such as school leaving certificate, school grades, career aspirations, internships, professional experience, certificates)
  • Data from applicant questionnaires
  • Data from aptitude tests that may still be carried out
  • Data from applicant interviews that may still be conducted
  • Information channels that led to the application.

The information about the information channels through which you became aware of us is evaluated exclusively in anonymized form and used for marketing measures.

(3) Special categories of personal data:

You agree that we may collect and process the following special categories of personal data:

If your application contains special categories of personal data (e.g. information about your health; a photo that allows conclusions to be drawn about your ethnic origin and, if applicable, your eyesight and/or religion), this may only be processed to this extent with your consent. You hereby consent to us processing the special categories of personal data contained in your letter of application for the purpose of carrying out the application process. This consent serves the sole purpose of being able to consider the application in its present form. The information will not be taken into account in the application process unless there is a legal obligation to do so, particularly in the case of severely disabled persons. Your data will not be passed on to third parties other than the aforementioned companies. You are not obliged to submit these special categories of personal data with your application. Submission or non-submission has no effect on your chances in the application process.

In the event of revocation, your data covered by the consent will be deleted immediately. However, if you withdraw your consent, your application that has already been submitted cannot be considered in its current form.

The hosting services we use serve to provide the following services: Infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services that we use for the purpose of operating this online offering.

In doing so, we, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors to this online offer on the basis of our legitimate interests in an efficient and secure provision of this online offer in accordance with Art. 6 para. 1 lit. f GDPR in conjunction with. Art. 28 GDPR (conclusion of order processing contract).

Β§ 13 Use of Google Analytics

(1) This website uses Google Analytics, a web analysis service of Google Inc (β€œGoogle”). Google Analytics uses β€œcookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will first be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information on behalf of the operator of this website for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.

(2) The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

(3) You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. (4) This website uses Google Analytics with the extension "_anonymizeIp()". This ensures that IP addresses are processed in a shortened form, preventing any direct personal reference. If any collected data is found to have a personal reference, it will be immediately removed, and the personal data will be deleted without delay.


(5) We use Google Analytics to analyze the use of our website and to continuously improve it. The collected statistics help us enhance our offerings and make them more interesting for you as a user. In exceptional cases where personal data is transferred to the USA, Google has committed to the EU-US Privacy Shield: https://www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Article 6(1)(1)(f) of the GDPR.

This website uses a web tracking service from ClickDimensions LLC (6849 Peachtree Dunwoody Road, Building B-1, Suite 200, Sandy Springs, GA 30328, United States of America). It uses cookies that are stored on your computer. These cookies enable an analysis of your use of the website. The information generated by the cookie about your use of this website is transferred to a server of ClickDimensions in the USA and stored there. ClickDimensions will use this information to evaluate your use of the website and compile reports on website activities for the website operators. ClickDimensions may also transfer this information to third parties if legally required.

Since your privacy is very important to us, we have prevented the transmission of your IP address within the framework of Google Analytics (see IP anonymization). Google will, therefore, never receive your IP address and cannot link it to other data stored by Google. No other personal or personally identifiable information is transmitted to Google. You can prevent the data collection by Google with the corresponding browser plugin. More details can be found in this privacy policy under the headings Google Analytics and Browser Plugin.

Β§ 15 Analysis by wiredminds

Our website uses the pixel tracking technology of wiredminds GmbH (www.wiredminds.de) to analyze visitor behavior. In doing so, data may be collected, processed, and stored, from which usage profiles are created under a pseudonym. Where possible and meaningful, these usage profiles are fully anonymized. Cookies may be used for this purpose. Cookies are small text files stored in the visitor's internet browser and serve to recognize the internet browser. The collected data, which may include personal data, is transmitted to wiredminds or directly collected by wiredminds. wiredminds may use information left behind by visits to the websites to create anonymized usage profiles. The data collected will not be used to personally identify the visitor to this website without separate consent, and it will not be merged with personal data about the person behind the pseudonym. If IP addresses are recorded, they are immediately anonymized by deleting the last block of numbers.

Β§ 16 Use of Social Media Plugins

(1) We currently use the following social media plugins: Facebook, Xing, LinkedIn, Kununu. We use the so-called two-click solution. This means that when you visit our site, no personal data is initially shared with the plugin providers. You can identify the provider of the plugin by the label on the box, either by its initial letter or logo. We give you the option to communicate directly with the plugin provider by clicking the button. Only when you click on the marked box and thereby activate it, the plugin provider will receive the information that you have accessed the corresponding page of our online offer. Additionally, the data mentioned in Β§ 3 of this declaration will be transmitted. In the case of Facebook and Xing, according to the respective providers, the IP address is immediately anonymized after being collected in Germany. Therefore, by activating the plugin, personal data is transmitted to the respective plugin provider and stored there (for US providers, in the USA). Since the plugin provider collects data, particularly via cookies, we recommend that you delete all cookies through your browser's security settings before clicking the greyed-out box.

(2) We have no influence over the data collected or the data processing procedures, nor are we aware of the full scope of data collection, the purposes of processing, or the storage periods. We also have no information regarding the deletion of the collected data by the plugin provider.

(3) The plugin provider stores the data collected about you as usage profiles and uses this data for advertising, market research, and/or for the design of its website tailored to your needs. Such evaluations are carried out, in particular (even for non-logged-in users), to display targeted advertising and inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, and you must contact the respective plugin provider to exercise this right. Through the plugins, we offer you the opportunity to interact with social networks and other users, allowing us to improve our services and make them more interesting for you as a user. The legal basis for using the plugins is Article 6(1)(1)(f) GDPR.

(4) Data transfer occurs regardless of whether you have an account with the plugin provider and are logged in. If you are logged in to the plugin provider, the data collected by us will be directly linked to your account with the plugin provider. If you click on the activated button and, for example, link the page, the plugin provider will also store this information in your user account and share it publicly with your contacts. We recommend that you log out of social networks regularly, particularly before activating the button, as this helps avoid linking your profile with the plugin provider.

Β§ 17 Embedding of YouTube Videos

(1) We have embedded YouTube videos in our online offering, which are stored on www.YouTube.com and can be played directly from our website. These videos are all embedded in "extended data protection mode," meaning no data about you as a user is transferred to YouTube unless you play the videos. Only when you play the videos will the data mentioned in paragraph 2 be transferred. We have no control over this data transfer.

(2) By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our website. Additionally, the data mentioned in Β§ 3 of this declaration will be transmitted. This occurs regardless of whether YouTube provides a user account to which you are logged in or if no user account exists. Β§ 18 Google Web Fonts

This page uses so-called Web Fonts, provided by Google, for the consistent display of fonts. When you visit a page, your browser loads the required Web Fonts into its cache to correctly display text and fonts.

For this purpose, the browser you are using must establish a connection to Google’s servers. This allows Google to learn that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of ensuring a uniform and appealing presentation of our online offerings. This constitutes a legitimate interest under Art. 6(1) lit. f GDPR.

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as inquiries you send to us as the website operator. You can recognize an encrypted connection by the fact that the address bar of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar. When SSL encryption is enabled, the data you transmit to us cannot be read by third parties.

Β§ 22 Objection or Withdrawal of Consent to the Processing of Your Data

(1) If you have given consent to the processing of your data, you can withdraw it at any time. Such withdrawal will not affect the lawfulness of the processing of your personal data carried out before you communicated your withdrawal to us.

(2) If we base the processing of your personal data on a legitimate interest, you have the right to object to the processing. This applies when the processing is not necessary for the performance of a contract with you, as we outline in the following descriptions of the functions. When exercising this right to object, we ask that you explain the reasons why we should not process your personal data as we have done. In the event of a justified objection, we will review the situation and either stop or adjust the data processing, or we will provide you with our compelling legitimate reasons for continuing the processing.

Β§ 23 Data Deletion

The data we process will be deleted or restricted in accordance with Articles 17 and 18 of the General Data Protection Regulation (GDPR). Unless explicitly stated otherwise in this privacy policy, the data stored by us will be deleted as soon as they are no longer necessary for the purposes for which they were collected and no legal retention periods prevent their deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

According to legal provisions in Germany, retention is required for 6 years in accordance with Β§ 257(1) HGB (e.g., commercial books, inventories, opening balances, financial statements, business correspondence, accounting documents) and for 10 years in accordance with Β§ 147(1) AO (e.g., books, records, management reports, accounting documents, business and commercial letters, tax-relevant documents).
